AI voice agents for gym membership sales and win-back call former members and people who toured but never joined. Because the call sells, it generally needs prior express written consent first. The greeting names the club and how to stop. The agent asks why they left, then reads one offer from the club's system; it never signs anyone up.
Key Takeaways
- A past membership is not consent; call only numbers with written consent.
- Ask why they left first, then read one offer from your system.
- A spoken stop goes to your own list, and the call ends.
This post is part of our guide to AI voice agents for gyms and fitness studios. The guide's section "Prospects: trial visits, tours and membership sales" puts this call in one line: "The sales and win-back call is a marketing call, so it goes only to numbers with prior express written consent for AI calls on file." Here is that call in full, run in Dograh, an open-source, self-hostable voice agent platform.
Who goes on a win-back list
A win-back list comes from the club's own records, and not everyone in them belongs on it.
Two groups belong on it: former members, and people who toured or tried the club but did not join. The Health & Fitness Association's 2026 consumer report, based on a yearly survey of about 18,000 US residents, counted 81 million members of gyms, studios and other fitness facilities in 2025, up 5.2% from 2024. With that many people joining, and some leaving each year, a club's records build up a long list of former members, and the consent check below decides who gets a call.
Some people stay off the list. A member who asks to cancel is never offered a win-back deal in that call. The request follows the flow in AI voice agents for membership freeze and cancellation requests. New web leads who asked for a first visit get a booking call instead, covered in AI voice agents for free-trial and tour booking at gyms. Members who still pay but have stopped visiting get a different call. In our view that should be a check-in with no offer, because an offer changes the consent rule.
Export the list from your gym management software with a consent flag on each record, leave out anyone without one or with an opt-out, and upload it to Campaigns as a CSV. Each extra column becomes a variable the agent can use.
Written consent comes before the first dial
A win-back call makes an offer, so it is generally telemarketing, and with an AI voice it needs signed written consent. This section is general information, not legal advice.
In its February 2024 declaratory ruling, the Federal Communications Commission (FCC) confirmed that the Telephone Consumer Protection Act's (TCPA) restrictions on the use of "artificial or prerecorded voice" "encompass current AI technologies that generate human voices." Under 47 CFR 64.1200, a call "that includes or introduces an advertisement or constitutes telemarketing" in an artificial voice to a mobile number is barred "other than a call made with the prior express written consent of the called party". Paragraph (a)(3) covers home lines.
The rule defines that consent as "an agreement, in writing, bearing the signature of the person called that clearly authorizes the seller" to make such calls to a stated number, and the person must be told that signing is not a condition of buying.
So a past membership is not a consent record. A membership agreement that took the number for billing generally does not cover sales calls. A common fix is a separate checkbox on the join form that names the club and is not required to join, kept in your gym software.

Sales calls to homes are also barred "before the hour of 8 a.m. or after 9 p.m." local time. A Dograh campaign's calling hours run in one time zone, so a chain across time zones runs one campaign per zone. Confirm your position with counsel.
The greeting names the club and how to stop
The rule sets the opening: who is calling, then how to stop.
Paragraph (b)(1) says the message must, "At the beginning of the message, state clearly the identity of the business". For telemarketing, paragraph (b)(3) adds a voice or keypress opt-out "within two (2) seconds of providing the identification information". Dograh's Greeting Text is the fixed line played word for word as the call connects, so put both there: the club's registered name, then a line such as "If you'd rather we didn't call, just say stop." If you want to tell callers they're speaking with an automated assistant, or your location requires it by law, write it here too.
A fixed greeting per contact, as text or a recorded clip, can come from the campaign file; contacts without one hear the agent's normal greeting. It may use the first name, never membership details, because it plays before anyone is verified. The First 15 Seconds Decide Everything in AI Outbound Calls covers how that opening should sound.
Voicemail handling is off by default. Turn it on in Settings under Voicemail & Screening and choose "Disconnect the call", because a sales message left on voicemail is still a sales call.

Ask why they left, then make one offer
The agent confirms who answered and asks why they left before it reads one offer.
The agent asks for the person by name, which finds the record but does not prove who is speaking. Before it mentions their old plan, tell it in the prompt to ask for an approved check, such as date of birth or the last digits of the member number. If someone else answered, tell it to leave only the club's name and a callback number.
Then it asks what made them leave and records the answer as stated, because the reason decides the offer. Someone who moved away needs nothing, while a price leaver might want a lower-priced off-peak plan. An HTTP API tool sends the stated reason to your gym software or offer system and gets back what the club can actually provide. The agent reads that one offer with its full monthly price and terms as returned, never a figure from its prompt.
The same listen-first pattern runs in AI voice agents for win-back in telecom. If the reason is an injury, tell the agent in the prompt to give no medical or training advice and to offer a call from a trainer instead. A no ends the offer, with no second pitch.
A yes, a no and a stop
A yes books a visit or goes to a salesperson. To book, a second HTTP API tool reads open tour times, the agent reads the chosen time back, and the tool writes it. Add a Preset Parameter named workflow_run_id, type Number, with the value {{initial_context.workflow_run_id}} so a retried request never books twice.
To hand over, use Transfer Call. Transfer Call works on Twilio, Telnyx and Asterisk ARI. It passes no summary by default; on Twilio it can play a short spoken introduction to both people. Write the details to your system with an HTTP API tool before the transfer. If nobody answers, the caller stays with the agent; tell it in the prompt to offer a callback.
The agent never signs anyone up or takes a payment. Dograh has no keypad (DTMF) tool and no feature for taking payments on a call. Recordings and transcripts keep whatever is said, so the call never asks for a full account, card or Social Security number; use a short check such as the last four digits, and send payment links by text or email from your own system. Joining happens at the club's own sign-up, where the member signs the terms.
A stop must outlast the call. Dograh keeps no do-not-call list. When a caller opts out, an HTTP API tool writes it to your own list, and you remove those numbers before the next campaign upload. Tell the agent in the prompt to treat "stop" as an opt-out. The call then ends through the End Call tool, whose goodbye line is fixed text or a recorded clip. The do_not_call call tag records the request but never blocks a later call.
To stop calling someone mid-campaign, pause the campaign and start a new one from a corrected list. For lists that change daily, start calls from your own system with the API Trigger, so your system decides who is called. Self-hosted Dograh has no per-minute platform fee (servers, model keys and phone minutes still cost); Dograh Cloud has a 1¢-a-minute platform fee.

Glossary
- Prior express written consent
- Under 47 CFR 64.1200(f)(9), a signed written agreement that clearly authorizes a seller to make telemarketing calls with an artificial or prerecorded voice to a stated number, and says signing is not a condition of buying. A gym win-back call in an AI voice generally needs it.
- Opt-out mechanism
- The voice or keypress way to stop calls that a telemarketing call in an artificial voice must offer within two seconds of naming the business. In a Dograh call, the agent takes the request by voice and an HTTP API tool writes it to the club's own list.
- Win-back call
- An outbound call to a former member, or someone who toured but did not join, that makes an offer to bring them back. Because it sells, it is generally a marketing call with stricter consent rules than a class reminder.
- Approved check
- A question the club's system can confirm, such as date of birth or the last digits of the member number, asked before the agent mentions anything from the person's record. A name or phone number only finds the record.
